Approval to amend the tow service agreement between the Smyrna Police Department and Barrow Enterprises (2261 Dixie Avenue SE Smyrna, GA 30080) to reflect a new law change, as well as fee adjustments that are a result of this new legislation.
Body
ISSUE: The Smyrna Police Department and Barrow Enterprises have entered into agreement to utilize Barrow Enterprises as the tow service for all services related to the removal and storage of impounded and abandoned vehicles.
Barrow Enterprises has requested revisions to their fee schedule and the Police Department has reviewed and supports the revisions. The requested revisions mimic the current fees Barrow Enterprises has in place in their tow service agreement with Cobb County Police Department.
This revision request does not affect the Smyrna Police Department or the City of Smyrna in the services this vendor provides, fiscally or administratively.
BACKGROUND: A new law became effective September 1, 2019 changing the procedures handling vehicle foreclosure on abandoned motor vehicles. As a result, the costs of researching information and setting up cases in Magistrate Court escalated. The amount of time needed internally to handle these new processes also increased. Barrow Enterprises covers these cost with the administrative and storage fees. The basic tow increase not only aligns our agreement with what Barrow Enterprises currently has in place with Cobb County, but helps cover cost increases in equipment, training, and insurance.
RECOMMENDATION/REQUESTED ACTION: The Police Chief and staff supports this agreement revision and recommends approval from the Mayor and City Council.
