Approval of Stormwater Management/BMP Facilities Covenant agreement template for the City of Smyrna

ISSUE: For the Old Ivy Village project, the owner has requested that this be an actual agreement, signed by both the City and the applicant. Their attorney has worked with the City's attorney to revise some of the language in the template, and have provided a signed copy (attached) to be signed by the City.
BACKGROUND: Our ordinance Section 46-143 (d) requires Inspection and Maintenance agreements to be recorded for newly constructed stormwater management facilities. Until now, applicants have completed a draft version of the document for review at the time of permitting, to be recorded prior to final acceptance of the project by the City. For reference, I have attached a copy of the template in Word format.
