Approve the amendment to the City of Smyrna 's Code of Ordinance Chapter 46 entitled Environment to include Section 46-8 which prohibits smoking within all City owned facilities and parks properties

ISSUE: Section 46-8 entitled No Smoking will be a new section of the City's Code of Ordinance Chapter 46 entitled Environment. The purpose of this section is to prohibit smoking within all city owned facilities, real property, and parks in order to protect the health, safety, and welfare of the public.
BACKGROUND: City staff was directed to draft language to prohibit smoking within all city owned facilities, real property, and parks properties after we received complaints about people smoking within our parks. This No Smoking Ordinance is not an attempt to criticize smokers or to ban all smoking. It is simply a way to ensure that everyone who uses our city facilities and parks breath smokefree air. In order to properly educate and notify the public about this new law, staff recommends that the ordinance take effect 30 days from the date of City Council's approval.
RECOMMENDATION/REQUESTED ACTION: Staff recommends approval of Section 46-8 entitled No Smoking to be effective 30 days from the date of City Council's approval.
