Title
Approval of RES2019-05 a Resolution of the City of Smyrna reminding restaurant owners of their ability to prohibit smoking.
Body
ISSUE: The Georgia legislature adopted the Georgia Smokefree Air Act of 2005. This state law specifically provides that owners of restaurants may declare the enclosed area within the entire facility as well as the outdoor area of the facility as nonsmoking areas. In addition to the state law, in 2014 the City of Smyrna recognizing that prohibiting smoking within the city owned facilities protects the health safety and welfare of the public, adopted an ordinance prohibiting smoking within any indoor or outdoor public facility subject to certain exceptions. The result of the state and city laws has been to reduce or eliminate smoking from most public areas and private businesses including restaurants, however a few restaurants have elected to either offer smoking areas or be designated as a location where smoking is allowed.
