Title

Approval of ORD2018-08 to amend the City of Smyrna Code of Ordinances Sec 6-46 regulating the carry-out of alcoholic beverages within authorized Restaurant Districts; and to repeal any conflicting provisions.

ISSUE:

The amendment to Chapter 6, Sec. 6-46 “Carry-in prohibited” would eliminate the signage requirement for businesses, prohibit the consumption of alcoholic beverages within parking lots and public buildings.

BACKGROUND

After receiving feedback from local businesses after the implementation of the previous amendments to Sec 6-46, the City seeks to simplify compliance with the new carry-out regulations and provide businesses with clear authority to refuse entry of alcoholic beverages purchased from another business inside of the Restaurant District.

 

City staff communicated with affected restaurants in the Smyrna Market Village area on April 13 to ensure they are aware of these proposed changes.

 

The signage requirement was introduced as part of the original amendment and subsequently determined that it would be applicable to all alcohol license holders within the city rather than only those within a Restaurant District, and this was deemed counterproductive to the intent of the original amendment.

 

The revisions regarding parking lots was added to make abundantly clear that the consumption of alcoholic beverages is only allowed in certain areas of the Restaurant District designed for safe pedestrian activity. The restriction on public facilities is so that if future districts include a public facility, it is clear that alcohol is not permitted inside unless specifically authorized by the City of Smyrna.

 

It also revises numbering due to the elimination of the subsection regarding signage.

 

RECOMMENDATION/REQUESTED ACTION

Staff recommends approval.
