Title

Approve the amendment to the City of Smyrna's Code of Ordinances Chapter 102 by adding Article V, Water System to include new Sections 102-15, 102-16, and 102-17 to satisfy mandatory requirements set forth by the Metropolitan North Georgia Water Planning District (MNGWPD) and Environmental Protection Agency (EPA).

Body

ISSUE AND BACKGROUND:  Adopt to Code of Ordinances, Article V, Water System, to include Section 102-15 Use of Private waste water disposal facilities, 102-16 Rain sensor requirements for landscape irrigation systems, 102-17 Water waste for outdoor water use. These updates are to satisfy mandatory requirements set forth by the (MNGWPD) and the (EPA) and request Mayor and Council to approve updates to Article V , Water System too include new sections in the City's Code of Ordinances.

 

December 17th 2019 Public Works received letter requesting that these new ordinances be put in place by Mayor and Council to satisfy that the City of Smyrna is making good faith effort to comply with the MNGWPD plan based off of EPD staff recommendations, and allowed in the O.C.G.A. 12-5-582 (e)(3), 583 (e)(3), and 584(d)(3). During this good faith effort it was requested these ordinances be put in place before April 2020.

The three sections submitted are:

102-15- Use of private waste water disposal facilities.

102-16- Rain sensor requirements for landscape irrigation systems.

102-17- Water waste ordinance for outdoor water use.

 

Public Works, City Clerk and City Attorney have reviewed the proposed updates Article V, Water System and recommend the addition of Section 102-15- use of private waste water disposal facilities. 

 

RECOMMENDATION / REQUESTED ACTION:  Staff request approval of the updates to Article V, Water System, to include the new sections in the city's Code of Ordinances.
