Body

ISSUE: To create an ordinance that provides laws on the use of motor vehicle restraining device (Booting).

 

 

BACKGROUND   there are locations that have used motor vehicle restraining device (Booting) to address illegal parking on privately owned property and at times as a revenue generator.  We do respect the right of a property owner not to be victimized by someone illegally parking on their property.  However, we have had in the past booting companies hired by property owners collect an extremely high fine to remove a motor vehicle restraining device (Booting), and required the violator to pay only in cash.  Most times this occurs in the late hours and puts the person in jeopardy if they do not have the cash and has to walk to an ATM to get cash and walk back and possibly become a crime victim.  This type of ordinance follows state law.
