Approval of extended work hours for Innovative Roofing Group to complete re-roof work at Market Village on Sundays from 9 am to 6 pm, March 22, 2020 to April 26, 2020

ISSUE AND BACKGROUND:
Innovative Roofing Group, the contractor for the re-roof work at Market Village, is requesting an extension of normal work hours. Due to the adverse weather conditions of the past two months, there have been limited days available to complete work such as re-roofing. The applicant is requesting the following work hours on Sundays:
• Sunday - 9 a.m. to 6 p.m. from March 22nd to April 26th
The contractor believes the work can be completed in 2 weeks with good weather, or six to seven weeks if adverse weather conditions continue.
The subject property is located in Market Village and is surrounded by public and commercial uses.
Per the City of Smyrna Code of Ordinance Section 46-1(b)(2)(d), noise in excess of 60 dBA for the construction of a structure shall only be permitted between the hours of 9 a.m. to 6 p.m. on Saturday and no work is allowed on Sunday. The intent of the ordinance is to protect surrounding residential properties form the noise created by construction on-site.
RECOMMENDATION / REQUESTED ACTION: Community Development has reviewed the request and is supportive of the work hours at 9:00 a.m. and ending at 6:00 p.m. on Sunday. The request for early start times on the weekend is due to adverse weather conditions. This extension will allow the project to be completed on schedule. Community Development recommends approval of the extended work hours with the following condition:
1. Innovative Roofing Group shall notify the adjoining property owners prior to any work planned for Sundays.
