ISSUE AND BACKGROUND

Recently, the Georgia legislature adopted OCGA Sec 3-3-10 which allows , a packaged goods retailer, through an employee or third party, to deliver malt beverages and wine in unbroken packages, subject to stringent terms and conditions which are specified by the new state law. Currently Sec 6-38 prohibits delivery of alcoholic beverages beyond the licensed premises. This amendment to Sec 6-38 would allow delivery as long as all conditions of the new state law are met.

 

RECOMMENDATION / REQUESTED ACTION:  Staff and the City Attorney recommend approval of ORD2020-15 for an amendment to Sec 6-38, Delivery by Retailer Beyond Licensed Premises and to authorize the Mayor to sign and execute all related documents.
