ISSUE AND BACKGROUND: 

Incident to the Windy Hill Boulevard the city sought to acquire a temporary construction easement over a very small portion of this property and adopted a declaration of taking to accomplish this. The declaration also sought to close two access points into the property. Subsequently, engineering has come up with a way to do the project without this easement and without touching the access points.

RECOMMENDATION / REQUESTED ACTION:  Staff recommends adoption adoption Resolution 2020-11 rescinding, withdrawing and abandoning  the Declaration of Taking issued July 20^th, 2020 for the tract of land known as a portion of 2415 S. Cobb Drive, Smyrna, Georgia and located in Land Lot 346 of the 17th District of Cobb County owned by Glennwood Properties, LLC., and authorize the Mayor to sign and execute all related documents
