ISSUE AND BACKGROUND:
Cobb County School Board owns certain real property known as the Rose Garden Hills School site located at 1839 Turpin Road, Smyrna, Georgia 30080 including the portion of the School Site outside of the perimeter fence which surrounds the school building as described in Exhibit A as attached and referred to as the Rose Garden Park.
The City desires to use a portion of the School Site for public park purposes in exchange for the City's agreement to maintain and provide services for the area used as a public park. Throughout the term, the City shall, at the City's sole expense, service and maintain the Rose Garden Park in clean and good condition and repair including without limitation: the playground, open field area, tennis courts, multipurpose basketball courts, the support building housing the restrooms, landscaping, retaining walls, walking trail, infrastructure and improvements, provision of first responder services, and provision of trash removal services all in accordance with the City's Parks and Recreation Ordinances and the rules and regulations of the City's Parks and Recreation Department, all of which are incorporated herein by reference. The City's service and maintenance of Rose Garden Park serves as the consideration for the City's use of Rose Garden Park, and as such, no additional monetary rent shall be payable by the City for the use of the Rose Garden Park....
